Question: When can I file for a divorce?
Answer: Either you or your spouse must live in Arizona for at least 90 days before you can file for a dissolution. Unless Arizona was the last state where you lived together with your spouse or your spouse is served within Arizona, the Court cannot divide community property, or the payment of community debts, child support or maintenance, unless both spouses agree in writing that the Court may do so. If custody of a child is requested, a longer period of residence for the child may be required, usually six months. (A.R.S. §25-312)
