Question: I rent a mobile. This mobile now has black mold inside the walls and in closets everywhere. The landlord tells me just to move, that it's only from the monsoon. I can't afford to move. Isn't he responsible for the condition of the mobile?
Arizona Revised Statutes Residential Landlord Tenant Act applies as the mobile home itself is rented as premises. A.R.S. § 33-1324 says that a landlord shall maintain the premises in compliance with building codes affecting health and safety and make repairs to keep the premises fit and habitable and clean and safe. A.R.S. § 33-1363 says that if the landlord fails to comply with A.R.S. § 33-1324, and the reasonable cost of compliance is less that three hundred dollars, or eaquals 1/2 of monthly rent, the tenant may recover damages in a lawsuit or can notify the landlord in writing of the tenant's intention to correct the problem. The landlord then has ten days in which to make repairs, and if not done, the tenant can cuase the repairs to be done by a licensed contractor. After that, the tenant can deduct the cost of the repairs from the monthly rent.
